Dear Representative,
I am writing to urge you to vote NO on HB 289, the bill expanding civil liability for the “wrongful death of an unborn child.” This legislation introduces sweeping new definitions and legal rights that could create confusion, invite harmful lawsuits, and undermine the ability of families and medical professionals to navigate pregnancy-related healthcare safely.
By defining an “unborn child” as a human at any stage of development, and by expanding who may bring a wrongful death action, SB 164 dramatically shifts Florida’s civil liability landscape. The bill risks opening the door to litigation that chills reproductive healthcare, interferes with private medical decisions, and creates unintended consequences for families already facing difficult circumstances.
While the bill includes narrow exceptions shielding mothers and lawful medical care from suit, these carveouts do not eliminate the practical risk that fear of litigation will discourage providers from offering necessary, medically appropriate care.
Floridians deserve compassionate, sensible policy that supports families — not legislation that creates legal uncertainty during some of the most vulnerable moments of their lives. Please stand with patients, parents, and medical professionals by opposing HB 289.
